ELIGIBILITY: – The U3 Coffee “Forest Park St. Patrick’s Day Parade” Sweepstakes (“Sweepstakes”) is open to legal residents of the United States or the District of Columbia who are 18 years of age or older at the time of entry and are legal residents of the United States or the District of Columbia.  Employees of U3 Coffee, its parent, subsidiaries, and affiliated companies, as well as the immediate family (spouse, parents, children and siblings) and household members of each such employee are not eligible to enter the Sweepstakes.  Participation in the Sweepstakes, and to any daily drawings for which entrant may be eligible by participating in this Sweepstakes, constitutes entrant’s full and unconditional agreement to the Official Rules and the Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes and any daily drawing.  Winning a prize is contingent upon adhering to all requirements set forth in these Official Rules.

THE U3 COFFEE “FOREST PARK ST. PATRICK’S DAY PARADE” SWEEPSTAKES IS VOID WHERE PROHIBITED BY APPLICABLE FEDERAL, STATE OR LOCAL LAWS OR REGULATIONS

SPONSOR:  U3 Coffee, LLC., 7430 Madison St., Forest Park, IL 60130

ENTRY PERIOD: The Sweepstakes begins on March 2, 2024 at 10:00 a.m. CDT and ends on March 2, 2024 at 11:59:59 p.m. CDT.

HOW TO ENTER: To enter, access the following link: U3 Coffee “Forest Park St. Patrick’s Day Parade.” Entry Form. Entries must submit the requested information including email address AND take action to confirm once the email confirmation is sent.  Alternate entries to Sponsor via regular mail will also be accepted.  Sponsor is not responsible for late, lost, incomplete, corrupted, misdirected entries, or for computer or computer network errors at any point. Use of automated devices or “bots” is prohibited. If you use fraudulent methods or otherwise attempt to circumvent these Official Rules, your submission may be removed from eligibility at the sole discretion of Sponsor.

SWEEPSTAKES PRIZE DRAWING: Potential winner in the Sweepstakes will be selected in a random drawing by Sponsor on the first business day following the end of the sweepstakes from among all eligible entries received. Odds of winning a prize depend on the number of eligible entries received.

SWEEPSTAKES GRAND PRIZE: The prize is one year of free U3 Coffee or the U3 Coffee Grace & Simplicity Gift Tray. The winner will choose either a coffee subscription or gift tray. The retail value of the gift tray is $145 USD. The coffee subscription will be two (2) 12-ounce bags received on a schedule of once every month. Winner cannot change their subscription once it is selected and will receive the same coffees in twelve (12) separate orders of approximately $36 USD per order, total prize value between approximately $425 to $450 USD. The winner cannot choose limited-edition coffees, accessories, or gift cards as the prize. The prize of free coffee will be spread out over one year. The prize is non-transferable.  Sponsor, at its sole discretion, reserves the right to substitute a similar prize of comparable or greater monetary value if advertised prize cannot be awarded for any reason.  Winner is responsible for any applicable taxes and all other expenses associated with any prize not explicitly stated herein as being awarded.

WINNER NOTIFICATION: – The selected winners will be notified by email within two (2) business days of the drawing. The winners must respond to the notification within five (5) calendar days to claim the prize and provide necessary information for prize shipment. Failure to respond within the specified time may result in disqualification and selection of an alternate winner. Any prize notification or prize returned as undeliverable will be forfeited and awarded to an alternate winner. Winners may be required to sign and return an affidavit of eligibility in order to claim a prize and/or a publicity/liability release. Acceptance of a prize constitutes permission for Sponsor and its designees to use winner’s name and likeness for advertising and promotional purposes in any and all media now or hereafter known as determined by Sponsor without compensation, unless otherwise prohibited by law.  All information collected will be treated in a manner consistent with Sponsor’s privacy policy.  To view Sponsor’s privacy policy, go to https://u3coffee.com/privacy-policy/ .  The Sweepstakes is governed by the laws of the State of Illinois, with venue in Cook County, Illinois, and all claims must be resolved in the appropriate state and federal courts of Illinois.

GENERAL CONDITIONS: Sponsor’s computer is the official timekeeping device for receiving entries.  Sponsor, its parent company, affiliates, related parties, franchises, partners, retailers, divisions, subsidiaries, advertising and promotions agencies and each of their respective officers, directors, shareholders, agents, and employees (the “Released Parties”) are not responsible for technical, hardware, software, telecommunications, network, electronic, or telephone malfunctions or failures of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human or other error which may occur in this Sweepstakes, or for entries which are late, lost, stolen, misdirected, garbled, delayed by computer transmissions, damaged or illegible.  Sponsor reserves the right to cancel or modify this Sweepstakes if fraud, technical failures (including but not limited to computer virus, bugs or unauthorized intervention) or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion.  In such event, Sponsor reserves the right to award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment for the drawing at issue.  Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.  In the event of a dispute as to the identity of an online entrant based on submitted e-mail address, entrant will be deemed the “registered subscriber” of the e-mail account at issue.  The “registered subscriber” shall be deemed the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  Proof of entering information at Web site does not constitute proof of delivery or receipt.  Sweepstakes materials that have been tampered with or altered are void. The use of any automated launching or entry software or any other mechanical or electronic means that permit the entrant to automatically enter repeatedly is prohibited.

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF U.S. AND INTERNATIONAL CRIMINAL, CIVIL AND/OR COMMON LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.

LIMITATIONS OF LIABILITY: The Released Parties assume no responsibility for any injury or damage to entrants’ or to any other persons’ computer (whether hardware or software), relating to or resulting from entering or downloading materials or software in connection with this Sweepstakes.  By entering the Sweepstakes, all entrants (i) agree to be bound by the terms of these Official Rules and the decisions of the Sponsor, which are final and binding on all matters relating to this Sweepstakes, and (ii) assume all liability and release Released Parties from any liability whatsoever for any claims, costs, injuries, losses, actions or damages of any kind (including, without limitation, related to personal injury, death, damage to property, infringement of proprietary rights, rights of publicity or privacy or defamation) arising out of or in connection with: (1) entering the Sweepstakes, (2) acceptance of any prize, or (3) anything related to the Sweepstakes or the awarding of prizes, unless prohibited by law.

WINNER’S LIST: For a Winner’s List, available thirty (30) days following the end of the Sweepstakes, send an email request with the subject line “WINNER LIST REQUEST-FREE COFFEE FOR A YEAR SWEEPSTAKES-MARCH 2023 to connect@u3coffee.com. Requests must be received no later than sixty (60) days following the date of the Prize Drawing.

SWEEPSTAKES DISPUTES:  As a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes which cannot be resolved between Sponsor and such entrant, and any causes of action arising out of or connected with the Sweepstakes, shall be resolved individually, without resort to any form of class action.  All entrants consent to the exclusive jurisdiction of the courts located in Cook County, Illinois, and agree that all matters pertaining to these Official Rules and disputes arising hereunder shall be governed by and interpreted in accordance with the laws of the State of Illinois, without regard to any conflicts or choice of law rules or provisions (whether of Illinois or any other jurisdiction). Further, notwithstanding the Terms, in any such dispute, under no circumstances will any entrant be permitted to obtain awards for, and each entrant hereby waives all rights to claim, punitive, incidental or consequential damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., his or her costs associated with entering this Sweepstakes), and each entrant further waives all rights to have damages multiplied or increased. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision of these Official Rules is found to be invalid or unenforceable, such provision shall be enforced to the maximum extent permitted by law and if not so permitted, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
